Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Luma mobile application, the Luma Health website, and related services operated by Amory Apps Corp ("we", "us", or "our") (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Important Health Disclaimer

If you have a medical condition, are pregnant, are undergoing fertility treatment, or take medication, consult your healthcare provider before following any plan or recommendation in the Service. If you experience a medical emergency, call your local emergency number immediately.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Accounts

Some features require you to create an account. You agree to provide accurate and complete information, keep it up to date, and maintain the confidentiality of your credentials. You are responsible for all activity under your account. Notify us immediately at support@lumahealth.me if you suspect unauthorized use of your account.

4. License and Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service, except as permitted by law;
• Interfere with or disrupt the operation or security of the Service;
• Access the Service by automated means or circumvent access restrictions;
• Upload or transmit content that is unlawful, harmful, defamatory, infringing, or otherwise objectionable;
• Use the Service to provide medical, dietetic, or other regulated professional services to third parties.

5. Subscriptions and Purchases

Certain features are available through paid subscriptions or one-time purchases. Billing, renewal, and cancellation are described in our Subscription Terms, and refunds are addressed in our Refund Policy, both of which are incorporated into these Terms by reference.

6. Content of the Service

Nutrition plans, lessons, articles, and recommendations in the Service are prepared for general audiences and personalized based on the information you provide. They are provided for informational and educational purposes only. Individual results vary and depend on many factors outside our control, and we make no representations about outcomes you may achieve.

7. User Content

You retain ownership of the content and information you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display such content solely as necessary to operate and provide the Service. Health-related information within your User Content is handled as described in our Privacy Policy.

8. Intellectual Property

The Service, including all software, designs, text, graphics, logos, lesson materials, and other content (excluding User Content), is owned by Amory Apps Corp or its licensors and is protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to you.

9. Third-Party Services

The Service may integrate with or link to third-party services, including app store platforms. Your use of third-party services is governed by their own terms and policies, and we are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, THAT ANY HEALTH, NUTRITION, OR FERTILITY OUTCOME WILL BE ACHIEVED, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMORY APPS CORP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify and hold harmless Amory Apps Corp and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 8 and 10–12) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction, except where applicable consumer protection law grants you the right to bring proceedings in the courts of your place of residence.

15. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice within the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the policies referenced in them, constitute the entire agreement between you and Amory Apps Corp regarding the Service.
